NCC, CBN unveil new framework: 30-Second refunds mandated for failed airtime transactions - ITREALMS

ITREALMS ... making leadership SENSE with digital news!

In a decisive move to protect digital consumers, the Nigerian Communications Commission (NCC) and the Central Bank of Nigeria (CBN) have jointly unveiled a regulatory framework mandating that subscribers receive refunds for failed airtime and data transactions within 30 seconds, reports
ITREALMS.

This major policy shift aligns with the consumer-focused objectives of both regulators and aims to eliminate the frustration of "debit without value," where subscribers are charged for services they never receive due to network downtimes, system glitches, or human error.

The new framework,

ITREALMS gathered, is the outcome of several months of high-level engagements involving the NCC, the CBN, Mobile Network Operators (MNOs), Value Added Service (VAS) providers, and Deposit Money Banks (DMBs).

These stakeholders convened to address the rising incidence of failed airtime and data purchases, which have increasingly led to subscribers being debited without receiving value and facing prolonged delays in resolution.

Representing a unified position by both the telecommunications and financial sectors, the framework identifies and tackles the root causes of transaction failures.

It prescribes an enforceable Service Level Agreement (SLA) for operators and banks, clearly outlining the roles and responsibilities of each party in the transaction and resolution process.

Under the strict new guidelines, if a purchaser is debited but fails to receive value for airtime or data, whether the failure occurs at the bank level or with an NCC licensee, the purchaser is entitled to a refund within 30 seconds.

The only exception applies to circumstances where the transaction remains pending, in which case the refund process must be concluded within 24 hours.

Furthermore, the framework mandates operators to notify consumers via SMS regarding the success or failure of every transaction.

It also addresses erroneous recharges to ported lines, incorrect airtime or data purchases, and instances where transfers are made to the wrong phone number.

Speaking on the development, the Director of Consumer Affairs at the NCC, Mrs. Freda Bruce-Bennett, disclosed that the framework establishes a Central Monitoring Dashboard to be jointly hosted by the NCC and the CBN.

She explained that the dashboard will enable both regulators to monitor failures, identify the responsible party, verify refunds, and track SLA breaches in real time.

Mrs. Bruce-Bennett noted that failed top-ups rank among the top three consumer complaints received by the Commission.

She emphasized that in line with their commitment to addressing priority issues, the regulators were determined to resolve the problem within the shortest possible time.

She expressed gratitude to all stakeholders, particularly the leadership of the Central Bank of Nigeria, for their tireless commitment to finalizing the framework and ensuring that consumers of telecommunications services receive full value for their purchases.

Highlighting the immediate impact of the initiative, Mrs. Bruce-Bennett revealed that even pending the final management approval of the framework, MNOs and banks have collectively made refunds of over N10 billion to customers for failed transactions.

According to the Head of Public Affairs at the NCC, Mrs. Nnenna Ukoha, full implementation of the framework is expected to commence on March 1, 2026.

This timeline allows for final regulatory approvals and the conclusion of technical integration by all MNOs, VAS providers, and DMBs.

Sanction looms: NCC uncovers multiple illegal deductions by mobile operators - ITREALMS

The Nigerian Communications Commission (NCC) has uncovered large volume of forceful and illegal deductions by Mobile Network Operators (MNOs) in the country, insisting that consumers must be refunded, reports ITREALMS.

NCC, in a public statement sighted by ITREALMS, the Commission noted that as a consumer-centric regulator, its dismayed by this act by MNOs with great displeasure.

The Commission said this is unacceptably high level of consumer complaints in respect of forceful subscriptions to Value-Added Services (VAS), as well as airtime deductions for these subscriptions.

ITREALMS gathered that NCC mandated several initiatives to tackle the menace, stressing these included the institution of a comprehensive investigation and resolution process, the Do-not-Disturb (DND) facility, and the imposition of sanctions for breach.
Additionally, NCC said, disturbed by the persistent occurrence of the menace despite these measures, it had carried out a long and comprehensive investigative audit into VAS subscriptions across all MNO and VAS platforms.

The investigative audit was led by the Compliance Monitoring and Enforcement Department of the Commission, with participation from its other Departments such as the Technical Standards and Network Integrity (TSNI), Consumer Affairs Bureau (CAB), Legal & Regulatory Services (LRS), and Licensing & Authorisation (L&A).

The Audit Team analyzed subscribers’ Call Detail Records from MNOs and subscription logs from VAS providers over a period of two years, leading to the conclusion that a huge percentage of VAS services were not voluntarily subscribed for. The audit team also found that some providers had implemented disingenuous mechanisms by which large numbers of innocent consumers were “forcefully” subscribed to VAS platforms, leading to regular deduction of their airtime without their consent.

As all Stakeholders are aware, the Commission has persistently insisted that actions of this sort are unacceptable as they are in direct breach of the Nigerian Communications Act and NCC’s many regulatory instruments on the matter. Such actions also undermine the very foundations of the customer/service provider relationship, that is, transparency and trust.

Based on the outcome of the investigative audit, the Commission will shortly be directing the indicted organisations to make refunds to affected consumers as appropriate. The Commission is also considering, and will impose appropriate sanctions as necessary. This outcome justifies the Commission’s commitment to evidence-based interventions.

We wish to use this opportunity to inform the general public that the Commission may suspend or outrightly decommission some VAS platforms and services in the overall interests of consumers. We assure consumers that these measures will be implemented with minimal inconvenience to them, and trust that we can count on the understanding of consumers who may be affected by these measures.

The Commission assures all Stakeholders that we will continue to use all available resources to protect the rights of consumers of telecoms services and to ensure that they get appropriate value for their interactions with service and platform providers.

Top 10 beneficiaries from FG refund on Paris Club loan

The oil-rich state of Rivers is leading in the top 10 beneficiaries from the recently released Federal Government (FG) refunds on Paris Club loan over-deductions between 1995 and year 2002, ITRealms exclusively reports.

ITRealms recalls that FG at the weekend released a State-by-State breakdown as the first tranche of Paris Club refunds paid to date.

This is coming as the top five states are from the Niger Delta region of the country, followed by Kano and Lagos in the sixth and seventh positions respectively, just as the remaining in the top 10 beneficiaries are from the north.

These include Katsina, Kaduna, Borno and Niger States in that order, whereas no state in the eastern region made it to the top 10, however, Imo State made it in top 12 with the sum of N14,001,610,365.94 billion.

Within the period under review, ITRealms gathered that between 1995 and 2002 that Rivers accrued refund amounted to 34, 925,785,322.06; Delta -27,606,963,362.46; Akwa-Ibom - 25,981,255,165.12; Bayelsa - 24,895,696,347.55; Kano - 21,740,390,362.48; Lagos - 16,743,876,266.21; Katsina - 16,404,261,819.71; Kaduna - 15,443,458,455.10; Borno         - 14,681,869,730.63; and Niger - 14,421,586,309.89.

ITRealms also reports exclusively that the top 10 collectively got refund worth N212,845,143,141.21 out of the N516.38bn (N516,384,636,883.81) shared among the 36 states of the federation and Federal Capital Territory, Abuja, upon the approval of Present Muhammadu Buhari on November 21st 2016 in partial settlement of long standing claims by State Governments relating to over-deductions from their Federation Account Allocation Committee (FAAC) allocation for external debt service arising between 1995 and 2002.

These debt service deductions were made in respect of the Paris Club, London Club and Multilateral debts of the FG and States. While Nigeria reached a final agreement for debt relief with the Paris Club in October 2005, some States had already been overcharged.

Director, Information at the Federal Ministry of Finance, Salisu Na’Inna Dambatta, told ITRealms, the funds were released to State Governments as part of the wider efforts to stimulate the economy and were specifically designed to support states in meeting salary and other obligations, thereby alleviating the challenges faced by workers.

The releases were conditional upon a minimum of 50 per cent being applied to the payment of workers’ salaries and pensions. The Federal Ministry of Finance is reviewing the impact of these releases on the level of arrears owed by State Governments.

Further, ITRealms reports that a detailed report is underway for presentation to the Acting President, Professor Yemi Osinbajo, as part of the process for approval for the release of any subsequent tranches.
