Onyeama travails: US-based attorney analysis indictment - ITREALMS

A United States-based Attorney, Mr. Ken Orji has given some insights into the news making a round over allegations against the chairman of AirPeace, Chief Allen Onyeama, reports ITREALMS.

He expressed dismay over all the allegations purportedly orchestrated from haters and detractors in Nigeria, maintaining that no matter what, Onyeama will not be jailed.

Orji also noted that basically two sticking points the United States focused on including, that

“1. He commingled charitable or non-profit organizations' money.

“2. That he used his US formed limited liability companies to sell to another Air Peace and made money, which ought to have been taxed. Not sure he paid any taxes.

“The transfers from the charitable accounts are illegal and he will be fined for it. Like I posted earlier, President Trump used money he raised from charitable contributions to buy art works and fund his hotel operations. He recently settled with New York AG and paid $2 million fine. No Jail Term. It's essentially a civil infraction.

“The letters of credit request from Fidelity to Wells Fargo and JP Morgan are normal. These clearly showed the sources of the funds and would not stick as criminal charges in the Courts. It's a kitchen sink strategy that piles on the heat but will generate zero fire.

“The big one is that Allen bought the planes and resold them to Air Peace while building in $2 million profits on the sales. Because Allen may not have paid any taxes on those, the US will argue that those gains were laundered money. There are about $6 million of those and they will likely be forfeited,” he said.

Further, Orji said, having written all these, the allegations in the indictment are all clearly very civil in nature and Allen's legal team will be able to quickly reach a settlement.

However, Orji said that bad news though, is that $6 million of those mark-ups sold to Air Peace will be taxed with statutory penalties. There will be a fine for commingling the charitable organizations' money. There will be civil penalties for not paying those assumed taxes in the year those deals were executed.

The outcome, Orji said is that $14 million will not come back to Allen, but he is not going to jail.

Indictment: Ekiti sacks VC EKSU, CMD, Provost, names Governing Councils - ITREALMS

Upon the consideration and adoption of the White Papers on the reports of the Visitation and Fact Finding Panels by the State Executive Council, the Governor of Ekiti State, Dr Kayode Fayemi, in his capacity as Visitor, has approved the removal of the Vice Chancellor of Ekiti State University,(EKSU), Ado-Ekiti; the Chief Medical Director (CMD) of Ekiti State University Teaching Hospital (EKSUTH), and Provost of the College of Education, Ikere-Ekiti, reports ITREALMS.

The most senior officials are to take over the running of the institutions pending the appointment of substantive heads.

In the case of EKSU, the Deputy Vice Chancellor (Academics), Prof (Mrs) Olubunmi Ajayi, is to take charge in an acting capacity pending the appointment of a substantive Vice Chancellor by the Governing Council.

The Governor also approved the appointment of Mrs Folakemi Falore as the Sole Administrator of the College of Health Sciences and Technology, Ijero-Ekiti

As approved by the State Executive Council, the Governing Councils’ immediate task is the implementation of the approved recommendations of the White Papers.

In the case of the College of Health Sciences and Technology, Ijero, the Sole Administrator is responsible for implementing the White Paper.

Chief Press Secretary to the Governor, Mr Yinka Oyebode in a press statement available to ITREALMS gave the names of the new governing council to include for EKSU, Prof Bamitale Omole (Chair), Chief Oluwole Ojo, Prof Adebayo Olukoshi, Prof Funmi Olonisakin, Prof Okey Onyejekwe, Mrs Foluso Olaniyan, Dr Amina Salihu, Mrs Mope Akerele, Prof Funso Falade, and Mr Matthew Imoru.

For the EKSUTH, he listed the newly appointed as Dr Dare Teniola (Chair),   Dr Adebola Orimadegun, Dr Adedolapo Fasawe, Prof Bosede Afolabi, Dr Janet Funke Ogunbunmi, Mrs Ajoke Oluwasanmi, and Prince Soji Agunbiade. 

As well for the COE, Ikere which has Chief Afolabi Ojuawo (Chair), Chief (Mrs) Moni Afuye, Prof Kola Oladunmoye, Mr S.I. Folorunso, Otunba Kunle Ajayi, and Mrs Jumoke Adamolekun, whereas the College of Health Sciences and Technology, Ijero, Mrs Folakemi Falore (Sole Administrator).

While the Broadcasting Service of Ekiti State (BSES) with Mr Segun Omolayo (Chair), Mr Gbenga Aruleba and Mr Kunle Olofin.

The CPS further hinted ITREALMS that the newly appointed members of the Governing Councils are to be sworn in on Monday, January 28, 2019.
