Oyo appeal: Judges fail to make copy of judgment available - ITREALMS

Informed sources close to the judiciary in Ibadan told our Correspondent that the Lead Counsel to Governor Seyi Makinde on the election petition matter, Mr. Eyitayo Jegede, SAN, has been left frustrated on the matter.
It was gathered that though Jegede instituted the process to secure the copy of the judgment immediately after the ruling, the Appeal Court has not made it available to the Counsel.
It was gathered that the staff of the Court of Appeal have told the lawyers that the Judges were trying to correct some errors in the judgment to prevent the errors from being made public.
“As of now, the copy of the judgment has not been made available and this could be dangerous. I can authoritatively inform you that Makinde’s lawyer initiated the process to get the judgment but he was frustrated. This is another reason for interested parties not to go to sleep, as something may be amiss,” the source said.
The source further said that the delay in releasing the court ruling may be dangerous because the Supreme Court has 60 days to determine the matter from the date of the ruling of the Court of Appeal.

NBA says DSS action unconstitutional, demands release of arrested judges now
The Nigeria Bar Association (NBA) may be spoiling for war
over the arrest of some three judges across the country at the weekend, describing
it as unconstitutional since the country is not under military rule, reports
ITRealms.
NBA also warned it will do everything possible to maintain
sanctity of judiciary and called on President Muhammadu Buhari to call the
Department of State Security (DSS) to order and for them to immediately release
the judges arrest in a few in the early hours of Saturday.
The NBA President, Abubakar Balarabe Mahmoud, ITRealms gathered made this calls while addressing the media, on Saturday, noting that
even within the judiciary, there are processes of handling such issues as
corruption and indiscipline and not the duty of DSS.
Mahmoud, who was accompanied by some senior members of the
bar at the press conference, included past presidents of NBA, and comprised Chief
Wole Olanipekun SAN, Olisa Agbakoba SAN, JB Daudu SAN, Others are former
Secretary, Dele Adesina SAN, Kemi Pinheirro SAN, Kanyinsola Ajayi SAN, Yusuf
Ali SAN, Monday Ubani, and others.
Mahmoud confirmed that several judges including justices of
the Supreme Court Okoro and Nkwocha were arrested by men of DSS between Friday
and Saturday.
He said that the information reaching his office, the raid
still continued and that those arrested have been moved to Abuja.
NBA insisted that President caution the security agencies by
directing them aright with the release of those judges without further delays
or strings attached.
The NBA, he said, will go to any length to protect the
sanctity of the judiciary.
"There will be grave consequences if the judges are not
released immediately,” he said.

DSS recovers N271,7m from 3 Judges
The Department of State Services (DSS)
has recovered the estimated sum of N271,740,326.07
from three judges arrested at the weekend across the nation, reports ITRealms.
DSS said this recovery was made in
what agency described as special sting operations involving some Judges of the Supreme,
Appeal and High Courts, cutting across N93,558,000.00; $530,087 about N166,072,038.37; £25,970
about N10,117,032.18; and €5,680
about N1,993,255.52.

Services, Abuja, Abdullahi Garba, told ITRealms on Saturday during a press
conference that these operations were based on allegations of corruptions and
other acts of professional misconduct by a few of the suspected Judges.
DSS action, he said, was in line with
its core mandate, as they have been monitoring the expensive and luxurious
lifestyle of some of the Judges as well as complaints from the concerned public
over judgment obtained fraudulently and on the basis amounts of money paid.
The judges involved, Garba said, were
invited, upon which due diligence was exhibited and their premises searched,
noted the searches have uncovered huge raw cash of various denominations, local
and foreign currencies, with real estate worth several millions of Naira and
documents affirming unholy acts by these Judges.
He also told ITRealms, some of them
have made useful statements while a few have declined even with the glaring
evidences that were found against them in terms of material cash, documents and
property recovered pointing to their compromise.
In one of the States, DSS said, where
the Service operations were conducted, credible intelligence revealed that the
Judge had Two Million United States Dollars ($2,000,000 USD) stashed in his
house. When he was approached for due search to be conducted, he in concert
with the State Governor, mobilized thugs against the Service team. The team
restrained itself in the face of unbridled provocative activities by those
brought in by the Governor. Unfortunately, the Judge and Governor also engaged
the tacit support of a sister security agency.
“The Service surveillance team noticed
that upon frustrating the operation, the Judge with the active support of the
Governor craftily moved the money to an unknown location which the Service is
currently making effort to unravel,” he said.
Meanwhile, large amount including
foreign, and local currencies have been recovered.
Other foreign currencies were also
recovered. This were recovered from just three (3) of the judges.
These in addition to other banking
documents, including real estate documents have been recovered. Meanwhile
preparations are ongoing to arraign them in a competent court of jurisdiction
in line with the laws of the nation.
The Service would want to clearly
state that it has never invited Justice Walter Nkanu Onnoghene for
investigation, neither is he being investigated by this Service. In addition
the Service would like to put it on record, that it has tremendous respect for
the Judiciary and would not do anything to undermine it or its activities.
The Service, Garba said, will also
join hands with this noble institution in its fight to rid it of few corrupt
Judges whose actions is undermining not only the Judiciary but the common bond
of our national life.
This current operation, DSS explained will
be sustained and followed till sanity and sanctity is restored to the esteemed
third arm of government and public confidence is regained.

MIIVOC decries crackdown on judges, says democracy in danger
A Civil Society Organization, Media Initiative against Injustice, Violence and
Corruption (MIIVOC) has condemned the invasion of the residence of a Federal
High Court Judge in Rivers State by security operatives, describing it as
irresponsible, reports ITRealms.
MIIVOC's Executive Director, Dr. Walter Duru, made available to ITRealms in Port Harcourt, Saturday, warned
that security operatives in the country were putting the nation's democracy in
jeopardy and called on President Muhammadu Buhari to call them to order.
"This latest development is a desecration of the sacred
institution of the Judiciary. If any member of the Bench is found wanting,
there are legal and civilized procedures. The laws of the land have made
sufficient provisions for disciplining of judicial officers and the gestapo
approach of the security agencies is NOT one of them, under the circumstance.
Why then do we have the NJC," he said.
Duru also expressed concern that the continued unconstitutional
conduct of security operatives could lead to anarchy, urging the APC-led
government to embrace the tenets of democracy in the interest of the country.
"Not even in the days of the Military did we experience
this kind of impunity. Reports of a threat on the life of the state governor,
Nyesom Wike is also shocking. Impunity is becoming a tradition and all well-
meaning Nigerians must speak out against this draconian display of brute force
and timidity. I am afraid that if this continues in Nigeria, there may be
lawlessness, as the citizens may resort to ways less than civil to check the
excesses of security operatives, thereby taking their destiny in their hands,
and when it degenerates to that level, the country is in trouble."
"Let the rights of every Nigerian be respected. Let the
rule of law be upheld. Let our democracy be respected and nobody, under
whatever guise should take us back to the dark days of Military dictatorship.
"The
Rivers State Police Commissioner and his DSS counterpart must be called to
order. Nigerians are hungry and groaning, as a result of inept leadership. This
daring move and sustained attacks on other arms of government is unacceptable. Let
the principle of separation of powers be respected.
"The least we expect from
the present administration is that they come up with creative ways of taking
the country out of recession, strengthen the legal framework against
corruption, refrain from selective justice, weed the administration of corrupt
elements and work towards fulfilling the electoral promises made to
Nigerians," Duru said.
MIIVOC chief said, "No amount of intimidation can silence
Nigerians. All we want is good governance and respect for the laws of the land"
and called for the reopening of hibernated high profile corruption cases.
